Eligibility Criteria
The eligibility conditions vary for each post. The deputation is open to officers of Central/State Governments, Union Territories, Universities, PSUs, Autonomous or Statutory Organizations, and recognized research institutions.
1. Deputy Registrar
Essential Qualifications:
- Degree in Law from a recognized university; and
- Experience:
- 10 years’ practice at the Bar, OR
- 10 years’ service in State Judicial Service, OR
- 10 years’ work in Legal Department of State/Central Government, OR
- 10 years’ experience in processing applications under Trade Marks/Geographical Indications Act, OR
- 10 years in teaching law in a recognized university.
OR
- Master’s Degree in Law from a recognized university with 8 years’ experience in teaching/research in law.
Desirable:
- Ph.D. in Intellectual Property.
2. Assistant Registrar
Essential Qualifications:
- Degree in Law from a recognized university; and
- Experience:
- 5 years’ practice at the Bar, OR
- 5 years’ experience in State Judicial Service, OR
- 5 years’ service in the Legal Department of State/Central Government, OR
- 5 years in processing applications under Trade Marks/Geographical Indications Act, OR
- 5 years in teaching law in a recognized university.
OR
- Master’s Degree in Law with 3 years’ experience in teaching or research in law.
Desirable:
- Ph.D. in Intellectual Property.
3. Examiner
Essential Qualifications:
- Degree in Law from a recognized university; and
- At least 2 years’ experience in:
- Handling court cases, OR
- Legal matters related to Trade Marks or Geographical Indications.
Desirable:
- Master’s Degree in Intellectual Property.
Duties & Responsibilities
Each role comes with distinct legal, adjudicatory, and administrative duties:
Deputy Registrar
- Acts as a Tribunal authority under the Trade Marks Act and GI Act.
- Conducts hearings of contested matters.
- Issues speaking orders and decisions.
- Represents and briefs the Central Government Counsel in court cases, including CAT, High Court, and other forums.
- Supervises Assistant Registrars, Examiners, and other staff.
- Any other duties assigned by senior officers (Joint Registrar/Registrar).
Assistant Registrar
- Functions as a quasi-judicial authority under the Acts.
- Hears and adjudicates contested applications.
- Issues decisions/orders on disputes.
- Represents the office in legal cases and briefs government counsel.
- Assists the Deputy Registrar in managing workload.
Examiner
- Examines new trademark applications as per the Act & Rules.
- Reviews responses to examination reports.
- Prepares notings, correspondence, and reports for senior officers.
- Guides applicants and stakeholders regarding registration procedures.
- Acts as a liaison officer between various registry sections and applicants.
Deputation Rules & Tenure
- Deputationists cannot claim regular promotion during tenure.
- Deputation period:
- Deputy Registrar: Up to 4 years.
- Assistant Registrar & Examiner: Up to 3 years.
- Maximum age limit: 56 years as of the closing date.
- Officers cannot withdraw candidature after volunteering.
- Selected officers may be posted anywhere in India.
